Terms of Service

These Terms of Service govern your use of the Bowey mobile application ("Bowey", "we", "us"). By creating an account you agree to these terms.

1. Service Description

Bowey is a personal IBS health diary. You log free-text entries about food, symptoms, stress, and other health-related events. The app uses AI to parse your entries into structured events and periodically runs a holistic analysis to surface trigger–symptom patterns.

2. Account

You must be at least 16 years old to use this service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Health Data & Not Medical Advice

Bowey processes health-related information you voluntarily provide. By using the service you explicitly consent to this processing as described in our Privacy Policy. Bowey is a personal pattern journal, not a medical device. It does not diagnose, treat, or provide medical advice. Pattern suggestions and insights generated by the app are informational only. Always consult a qualified healthcare professional about your symptoms, test results, or treatment decisions. Do not use Bowey as a substitute for professional medical care.

4. AI Processing

By saving a diary entry you consent to that entry's content being sent to OpenAI's API (via our server-side functions) for parsing and analysis. The mobile app never contacts OpenAI directly. AI-generated insights may be incomplete or inaccurate. You should not rely on them for medical decisions.

5. Subscription & Free Trial

Bowey offers a 7-day free trial from the date of account creation. No payment is required during the trial period. After the trial ends, continued access to the full app requires an active Bowey Pro subscription. Subscriptions are managed and billed by Apple through the App Store. By subscribing you also agree to Apple's payment terms. • Price: $9.99 per month (or the local equivalent as displayed in the App Store at the time of purchase). • Billing: your Apple ID account is charged at the start of each billing period. • Auto-renewal: subscriptions automatically renew each month unless cancelled at least 24 hours before the end of the current period. • Cancellation: you may cancel at any time via iPhone Settings → [your name] → Subscriptions → Bowey. Cancellation takes effect at the end of the current billing period — you retain access until then. • Refunds: we do not issue refunds for unused portions of a subscription period. Refund requests are handled by Apple in accordance with their App Store refund policies. • Trial conversion: if you subscribe before your 7-day free trial ends, you will not be charged until the trial period concludes.

6. User Responsibilities

You agree not to: • Upload or submit content that is illegal, harmful, or violates the rights of others. • Attempt to reverse-engineer, hack, or disrupt the service. • Use the service for any purpose other than your own personal health journaling.

7. Data Deletion

You may delete individual diary entries or your entire account at any time from the app settings. Deleting your account permanently and irreversibly erases all your data from our servers. This action cannot be undone.

8. Disclaimer

The service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of AI-generated pattern analysis.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Bowey shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service or reliance on AI-generated health insights.

10. Service Availability

We do not guarantee that the service will be available at all times. We reserve the right to modify, suspend, or discontinue the service at any time. Where reasonably practicable, we will provide advance notice of material changes.

11. Governing Law

These terms are governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Hungary.

12. Changes

We may update these terms from time to time. We will notify you of material changes via an in-app notice. Continued use of the app after changes are posted constitutes your acceptance of the updated terms.

14. Apple App Store Additional Terms

This Agreement is between you and Bowey only, not Apple, and Apple is not responsible for the Application or its content. License Scope: The license granted to you is limited to a non-transferable license to use the Application on any Apple-branded product that you own or control, as permitted by the App Store's Usage Rules. Maintenance and Support: We are solely responsible for providing maintenance and support for the Application. Apple has no obligation whatsoever to furnish any maintenance or support services. Warranty: We are solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility. Product Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Intellectual Property: In the event of any third-party claim that the Application, or your possession and use of the Application, infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Third-Party Beneficiary: You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.
